On 1 October 2004 the Immigration and Naturalisation Service (IND) started the phased implementation of the new procedure for highly skilled migrants. Employers with whom the IND has entered into an agreement for an accelerated MVV procedure can request a statement for the admission of highly skilled migrants from the IND. After 1 January 2005 employers who have not entered into such an agreement and who require the admission of highly skilled migrants can request a statement from the IND.
Standard statement
To effect the admission and residence of a highly skilled migrant, the employer of the highly skilled migrant must sign a standard statement as referred to in the Decree of 28 September 2004 amending the Foreign Nationals (Employment) Act Implementation Degree.
By signing this statement, the employer assumes a number of (generally applicable) guarantee obligations in the context of the highly skilled migrant policy and the accelerated procedure for processing applications for highly skilled migrants.
Only employers who have fully completed and signed the statement can submit applications for the admission and residence of a highly skilled migrant.
Highly skilled migrant application forms
The application forms for highly skilled migrants are presently only available via the Internet and not from the municipalities. Employers who have signed a statement will be given access to the application forms on the Internet with a personal code. They can complete the application forms via the highly skilled migrants section site.
In order to be able to process applications for a residence permit for a highly skilled migrant within the target period of two weeks the IND has opted, for the moment, to have these applications submitted directly to the IND highly skilled and employment migration department. However, the residence permit itself is issued by the municipality in which the highly skilled migrant resides or stays. Before the summer of 2005 an evaluation will be carried out of the final structure of the highly skilled migrant procedure.
Information
Employers with whom the IND has entered into an agreement for an accelerated MVV procedure can request a statement by writing to the IND highly skilled and employment migration department, Postbus 3022, 2280 GA Rijswijk, or by sending an e-mail to arbeid@ind.minjus.nl. The IND will issue the statement by mail as soon as possible, including information about the further progress of the procedure regarding the admission and residence of highly skilled migrants.
