A highly skilled migrant is allowed to work in the Netherlands, if it has been established that he/she has met the applicable residence conditions. A foreign national who travelled to the country with an MVV is allowed to work in the Netherlands during his or her application for a residence permit, because it has been established in the MVV procedure that he/she meets the conditions.
Foreign nationals who entered the country without an MVV are only allowed to work once the application for a residence permit has been decided on. For this reason, you can decide, after all, to commence an MVV procedure for a foreign national who is not subject to an MVV requirement.
You fill in the application form on the Internet. The highly skilled migrant will have to sign the form.
There are two possible ways to make an application for a residence permit:
1. You can send in the request by mail to the IND Highly Skilled and Employment Migration department.
2. You or the highly skilled migrant can file an application in person at the IND office for labour and highly skilled migrants. Prior to filing an application at this office, an appointment should be made through the phone number +31 (0)70-7795825.
When making an application, the employee will receive a sticker in his/her passport with which he can prove that he is in the Netherlands legally, in anticipation of a decision. This sticker will also indicate whether the employee is allowed to work whilst awaiting the decision.
If you or the employee make the application in person at the IND-office for labour and highly skilled migrants in Rijswijk, the IND will put the sticker in his/her passport then and there.
If you have made your application by post, you or the employee can get the sticker in his/her passport at one of the nine IND-offices. You can make an appointment to get the sticker via telephone number +31 70 779 5825. One requirement is that the application is made by regular mail and send at the IND-office for labour and highly skilled migrants in Rijswijk.
When at the date of the appointment the application is not known at the IND-office for labour and highly skilled migrants in Rijswijk the sticker will not be issued.
Be advised: The sticker can only be collected by the employer or the foreign national. An authorised representative cannot collect the sticker on behalf of the foreign national or the employer.
